Junk Rubbish Waste UK Service Terms

These Terms and Conditions set out the basis on which Junk Rubbish Waste provides waste collection and related services within the United Kingdom. By booking a collection, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person or business placing a booking for waste collection services with Junk Rubbish Waste.

Services means any waste collection, clearance, removal, loading, transportation, recycling and disposal services provided by Junk Rubbish Waste.

Waste means the items, materials, junk, rubbish or other waste presented by the Customer for collection as part of the Services, excluding any prohibited items.

Booking means a confirmed request for Services made by the Customer and accepted by Junk Rubbish Waste.

Contract means the agreement between the Customer and Junk Rubbish Waste for the provision of Services, incorporating these Terms and Conditions.

2. Scope of Services

Junk Rubbish Waste provides waste and rubbish collection, loading, removal and responsible disposal services to domestic and commercial Customers. The specific nature and scope of the Services will be as agreed at the time of booking, including the estimated volume or weight of waste, type of waste, and the collection address.

All Services are carried out subject to applicable waste management regulations and health and safety requirements. Junk Rubbish Waste reserves the right to refuse to collect any Waste that is hazardous, unsafe to handle, not as described at booking, or cannot legally be carried or disposed of.

3. Booking Process

3.1 Customers may request a booking by telephone, email, online form or other communication channels made available by Junk Rubbish Waste from time to time.

3.2 When requesting a booking, the Customer must provide accurate information, including but not limited to:

a. Full name and contact details.

b. Collection address and any access restrictions.

c. Description, approximate quantity and type of Waste.

d. Preferred dates and times for collection.

3.3 Junk Rubbish Waste will provide an estimated quotation based on the information supplied. This estimate may be revised if, on arrival, the Waste differs in type, volume, weight or access difficulty from what was originally described.

3.4 A Booking is only confirmed when Junk Rubbish Waste has accepted the request and provided confirmation to the Customer. Junk Rubbish Waste reserves the right to decline any booking request at its discretion.

3.5 The Customer is responsible for ensuring that any person at the collection address who deals with Junk Rubbish Waste on the day of service is authorised to act on the Customer's behalf.

4. Service Charges and Pricing

4.1 Prices are typically based on factors such as the type of Waste, estimated volume or weight, access conditions and any additional labour or waiting time required.

4.2 Unless otherwise stated, all prices are quoted in pounds sterling and may be subject to applicable taxes.

4.3 Where the actual Waste or circumstances at the site differ from those described by the Customer, Junk Rubbish Waste may adjust the price accordingly. Any revised price will be agreed with the Customer before work proceeds.

4.4 If the Customer does not agree to a revised price, Junk Rubbish Waste may refuse to carry out the Services and may charge a call-out or cancellation fee to cover time and travel costs.

5. Payments

5.1 Payment terms will be confirmed at the time of booking. For most residential Customers, payment is due on completion of the collection, unless otherwise agreed in writing.

5.2 Payment may be made by cash, card or other accepted methods as advised by Junk Rubbish Waste. For commercial Customers, account arrangements may be available, subject to approval and agreed payment terms.

5.3 Where credit terms are agreed, invoices must be paid in full by the due date. Junk Rubbish Waste reserves the right to charge interest on overdue amounts at the prevailing statutory rate, together with any reasonable costs incurred in recovering the debt.

5.4 The Customer is liable for all charges associated with the Services, including any additional costs arising from incorrect information, restricted access, waiting time, or the presence of prohibited or undeclared hazardous waste.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting Junk Rubbish Waste using the details provided at the time of booking.

6.2 If the Customer cancels with sufficient notice before the scheduled collection time, no cancellation fee will usually apply. Junk Rubbish Waste will advise what notice period applies for the relevant service.

6.3 Junk Rubbish Waste reserves the right to charge a cancellation fee if:

a. The Customer cancels or significantly changes the booking with insufficient notice.

b. Junk Rubbish Waste attends the collection address at the agreed time and is unable to gain access, or the Customer is not present where their presence is required.

c. The Waste is not available for collection or differs substantially from the description given, and the Customer chooses not to proceed with a revised quotation.

6.4 Junk Rubbish Waste may cancel or reschedule a booking if necessary due to operational, safety, regulatory or weather-related reasons. In such cases, Junk Rubbish Waste will use reasonable efforts to notify the Customer and agree a new collection time. No liability will arise for such cancellation or rescheduling, other than, where applicable, the refund of any prepaid charges for Services not carried out.

7. Customer Obligations

7.1 The Customer must ensure that Junk Rubbish Waste has safe and suitable access to the collection address, including any parking, loading and entry arrangements. Any permits or authorisations required for access or parking are the responsibility of the Customer unless otherwise agreed.

7.2 The Customer must ensure that Waste is presented in a safe manner and, where possible, separated or identified by type. Dangerous, sharp or heavy items must be disclosed, and reasonable steps taken to minimise risk.

7.3 The Customer must not present any prohibited or hazardous waste, including but not limited to asbestos, certain chemicals, clinical waste, explosives, gas cylinders, and other items not permitted under applicable laws or the policies of disposal facilities.

7.4 The Customer warrants that they either own the Waste or have the authority of the owner to arrange its collection and disposal. The Customer agrees to indemnify Junk Rubbish Waste for any claim by a third party alleging lack of authority or unlawful removal of items.

8. Waste Regulations and Environmental Compliance

8.1 Junk Rubbish Waste operates in compliance with relevant UK waste regulations and licensing requirements and will transport and dispose of Waste only at authorised facilities.

8.2 Where necessary, Junk Rubbish Waste will issue appropriate documentation to confirm that Waste has been collected and transferred in line with applicable regulations.

8.3 The Customer acknowledges that once Waste is collected, it may be reused, recycled, recovered or disposed of by Junk Rubbish Waste or its authorised partners in such manner as is lawful and environmentally appropriate.

8.4 Junk Rubbish Waste aims to maximise recycling and responsible disposal of collected Waste. However, no specific recycling or recovery rate is guaranteed unless expressly agreed in writing.

9. Limitations of Service

9.1 All collection times are estimates and subject to traffic, access conditions and operational constraints. While Junk Rubbish Waste will use reasonable efforts to attend within agreed time windows, time is not of the essence in relation to performance of the Services.

9.2 Junk Rubbish Waste may refuse to move any item that it reasonably considers to pose a health and safety risk or that may cause damage to property, vehicles, or personnel.

9.3 Where access to the collection address is limited or unsuitable for vehicles, Junk Rubbish Waste may, at its discretion, either cancel the job, impose additional charges for extra labour or walking distances, or require the Customer to present Waste at a more accessible location.

10. Liability

10.1 Junk Rubbish Waste will exercise reasonable care and skill in providing the Services. However, liability for any loss or damage is limited as set out in this section.

10.2 Junk Rubbish Waste will not be liable for any loss or damage arising from inaccurate or incomplete information provided by the Customer, inadequate access, or unsafe conditions at the collection address.

10.3 While reasonable care will be taken when removing Waste from buildings or premises, the Customer acknowledges that minor scuffs, marks or wear may occur, especially in confined spaces or where large or heavy items are involved. Junk Rubbish Waste will not be liable for cosmetic damage that is incidental to the proper performance of the Services unless caused by negligence.

10.4 To the fullest extent permitted by law, Junk Rubbish Waste will not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services or these Terms and Conditions.

10.5 In any event, the total aggregate liability of Junk Rubbish Waste in respect of any claim arising under or in connection with the Services shall not exceed the total price paid or payable by the Customer for the specific Service giving rise to the claim.

10.6 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

11. Complaints

11.1 If the Customer has any concerns or complaints regarding the Services, they should contact Junk Rubbish Waste as soon as reasonably practicable, providing details of the issue and any supporting information.

11.2 Junk Rubbish Waste will investigate complaints and endeavour to respond promptly with an explanation or proposed resolution. The Customer agrees to give Junk Rubbish Waste a reasonable opportunity to remedy any service issues.

12. Data Protection and Privacy

12.1 Junk Rubbish Waste will collect and process personal data supplied by the Customer for the purposes of managing bookings, delivering Services, handling payments and complying with regulatory obligations.

12.2 Personal information will be handled in accordance with applicable data protection laws. Junk Rubbish Waste will take reasonable steps to protect personal data from unauthorised access or disclosure and will only share it where necessary to perform the Services, comply with legal obligations or with the Customer's consent.

13. Force Majeure

13.1 Junk Rubbish Waste will not be liable for any delay or failure to perform the Services where such delay or failure results from events beyond its reasonable control, including but not limited to extreme weather, traffic disruption, accidents, industrial action, utility failures, or changes in law or regulation.

13.2 In such circumstances, Junk Rubbish Waste may suspend or cancel the Services and will use reasonable efforts to resume or rearrange them as soon as reasonably practicable.

14. Variation of Terms

14.1 Junk Rubbish Waste may amend these Terms and Conditions from time to time. The version in force at the time of the Customer's Booking will apply to that Contract.

14.2 Any changes that materially affect the Customer's rights will, where reasonably possible, be communicated or made available to Customers in advance.

15. Severability

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable.

15.2 Where such modification is not possible, the relevant provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties submit to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, subject to any mandatory rights the Customer may have under consumer protection legislation.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written quotation or confirmation provided at the time of booking, constitute the entire agreement between the Customer and Junk Rubbish Waste in relation to the Services. They supersede any prior discussions, correspondence or representations.

17.2 The Customer acknowledges that they have not relied on any statement, promise or representation not expressly set out in these Terms and Conditions when entering into the Contract.
